It is now possible to divorce amicably before the Notary. This is a procedure in which both spouses agree on all the effects of the divorce. It is also important that the spouses are of French nationality and that the marriage is contracted in France.
Each of the spouses must then be assisted by a lawyer who will be responsible for drafting the divorce agreement and looking after the interests of his client.
Thus, it is no longer possible for a lawyer to assist both spouses at the same time given that the Judge no longer exercises control on the consent of the parties: each lawyer is responsible for this mission on behalf of his client.
Once the agreement has been signed, the spouses are not required to go to the Notary. The lawyers will take care of this mission.
Divorce by mutual consent becomes possible when no child wishes to be heard by the judge. The time taken to pronounce a divorce is also reduced so that it is possible to obtain a judgment of divorce quickly.
There is no longer any territorial limitation so that a lawyer, wherever he is, can intervene anywhere in France.
Maître GASIMOV assists his clients in within the framework of an amicable divorce procedure throughout the national territory.
If one of the spouses does not have a lawyer, our firm will call on one of the colleagues with whom we usually work.
Customers are requested to provide the following documents: the birth certificate of each spouse (and possibly children) dated less than three months old, the marriage certificate dated less than three months ago, copy of the family record book, copy of the marriage contract if there is one, copy of maps identity, copy of the tax notice, health insurance number, proof of income, all proof relating to credits, property and the state of assets.
Regarding the Firm's fees, they are assessed on the basis of the client's financial situation. It is also possible to apply for legal aid in the context of a divorce procedure by mutual consent.
Clients are also advised to check with their insurance (legal protection) whether the latter covers the costs and fees of the lawyer.
